Part A — Terms of Service

1. Acceptance

By downloading, accessing, or using Rize, you agree to these Terms and the EULA (Part B). If you

do not agree, do not use Rize. You must be at least [18] years old to create an account and hold

a subscription. Rize is offered only to users in the United States and Canada; by using it

you represent that you are located in one of those countries.

2. What Rize does

Rize is a voice-first alarm and personal-companion app. Depending on your subscription tier, it

provides: alarms and reminders; a spoken morning briefing (news, weather, calendar, and optional

sports/stocks/verse-of-the-day sections you turn on); voice journaling; user-to-user voice

messages; and — on the family plan — a shared household experience with parent-owned child and

pet profiles, curated kid content, senior check-ins, and family reminders. Features vary by tier

(Section 4) and are described in the app.

3. Accounts

You are responsible for your account credentials and for activity under your account. Sign-in and

authentication are handled through [Supabase / Apple Sign-In / EMAIL — confirm auth methods]. Tell

us promptly at support@rizealarm.ai if you suspect unauthorized use.

4. Subscriptions, trial, billing & auto-renewal

Rize is offered as auto-renewing subscriptions, sold and billed through the Apple App Store

[and Google Play, if/when Android ships — confirm]. Current tiers:

Auto-renewal disclosure (Apple-required — confirm final wording matches App Store Connect):

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription automatically renews at the then-current price for the same period unless

auto-renew is turned off at least 24 hours before the end of the current period.

• Your account is charged for renewal within 24 hours prior to the end of the current period.
• Manage or cancel your subscription in your device's [App Store account settings]; deleting

the app does not cancel a subscription.

• Free-trial terms: if you do not cancel at least 24 hours before the trial ends, it converts to a

paid subscription at the applicable price. [Confirm trial→tier conversion default.]

• Prices are set in the app/store and may change; [we will give notice of price changes as

required by the App Store and applicable law].

• Refunds are handled by Apple under the App Store's policy; LOL Studio generally cannot issue

store-billed refunds directly. [Confirm.]

Prices exclude taxes, which may be added per your jurisdiction.

5. Third-party services

Rize relies on third-party providers to function, including [Supabase] (backend/database),

[OpenAI] (language model for the conversational assistant and briefing composition), [Replicate /

ElevenLabs / Inworld] (text-to-speech voices), [Twilio] (messaging), and [Apple] (payments,

notifications). Your use of Rize is also subject to those providers' terms where applicable. We do

not sell your personal information or your children's personal information to third parties (see

the Privacy Policy).

6. Acceptable use

You agree not to: use Rize for unlawful purposes; harass, abuse, or send unwanted messages to

other users; upload content you lack the rights to; attempt to reverse-engineer, disrupt, or

circumvent the app's security or subscription controls; or use Rize to record or clone any

person's voice without that person's consent (see Section 8 and EULA §B.3).

7. User content & voice messages

Rize lets you create content — voice journals, user-to-user voice messages, family messages,

"proud moments," and similar. You retain ownership of your content. You grant LOL Studio a

limited license to store, process, and deliver it solely to operate the features you use (for

example, delivering a voice message to its recipient or playing a family wake-up line on the

intended device). You are responsible for the content you create and send.

8. Voice capture & voice cloning

Rize's core design minimizes voice-data capture:

• Voice journaling and kid speech are transcribed on-device; the audio/transcript is used to

parse your request and is then discarded. Rize does not build voice-training datasets from user

or child speech. [Confirm this matches shipped behavior at launch.]

• Family voice features (a family member's voice used for a wake-up line, motto, or good-night

message) play only content the speaker recorded or explicitly approved. A voice is never

synthesized from a family member's speech without that member's consent, and unapproved content

is never played.

• Voice cloning (making a family message sound like the sender via a synthetic voice) is

[planned for a future release and] available only with the **explicit consent of the person

whose voice is used.** [Counsel: confirm the consent-capture UX and record-keeping meet

biometric-privacy laws — e.g. Illinois BIPA, Texas CUBI, Washington — before enabling; some

states treat voiceprints as regulated biometric identifiers.]

9. Availability, changes & "as-is"

We may modify, suspend, or discontinue features at any time. Rize is provided **"as is" and "as

available"** without warranties of any kind, to the fullest extent permitted by law. We do not

warrant that alarms, briefings, reminders, or check-ins will always be timely, accurate, or

uninterrupted. Do not rely on Rize as the sole safeguard for any safety-critical need

(including medication, medical, or emergency situations); senior check-ins and reminders are

convenience features, not medical or emergency-response services.

10. Limitation of liability

To the fullest extent permitted by law, LOL Studio is not liable for indirect, incidental,

special, consequential, or punitive damages, or for missed alarms, reminders, briefings, messages,

or check-ins. [Aggregate liability cap — e.g. the greater of amounts you paid us in the prior 12

months or US$[100]. Counsel to finalize; note some jurisdictions limit these exclusions.]

11. Indemnification

You agree to indemnify LOL Studio against claims arising from your misuse of Rize, your content,

or your breach of these Terms, to the extent permitted by law. [Counsel to scope.]

12. Termination

You may stop using Rize at any time and cancel your subscription via the App Store. We may suspend

or terminate access for violations of these Terms. Data handling after termination is described in

the Privacy Policy and in Section B.6 (family/child data).

13. Governing law & disputes

These Terms are governed by the laws of [GOVERNING LAW — e.g. the Province of Ontario, Canada, or a

U.S. state]. [DISPUTE RESOLUTION — venue; and decide whether to include an arbitration clause and

class-action waiver. Counsel: these are heavily regulated for consumer apps and for minors; draft

carefully and confirm enforceability in both the U.S. and Canada.]

14. Changes to these Terms

We may update these Terms; material changes will be notified in-app or by [email]. Continued use

after changes take effect means you accept them.
